Israeli Property Valuation for U.S. Taxpayers

Last Update - October 2026

Independent Real Estate Appraisal in Israel for U.S. Taxpayers, Property Owners and Their Professional Advisers

Do you own real estate in Israel and are you a U.S. citizen, resident or taxpayer?

IL APPRAISER provides independent Israeli real estate valuations for U.S. taxpayers who own property in Israel, as well as U.S. attorneys, CPAs, accountants, tax advisers and other professionals assisting clients with Israeli real estate.

A valuation may be relevant to U.S. tax reporting, capital gains, rental income, inheritance, estate planning, gifts, financial settlements or other professional matters.

It may also be useful for completely non-tax matters — such as deciding whether to buy a property, determining realistic rental income, evaluating an urban-renewal proposal or reviewing an Israeli Betterment Levy assessment.

Our role is to establish the value and relevant real-estate characteristics of the Israeli property.

When Might an Israeli Property Valuation Be Relevant?

You may be particularly interested in our service if:

  • You are a U.S. citizen or tax resident and own real estate in Israel.

  • Your CPA or tax adviser needs an independent property value.

  • You are selling or considering selling an Israeli property.

  • You need a valuation for a specific historical date.

  • You inherited an Israeli property or are administering an estate.

  • You are considering transferring Israeli property as a gift.

  • You are involved in a divorce or financial settlement.

  • You own an Israeli rental property and want to determine its market rental value.

  • You are considering buying an Israeli property or investing in Israeli real estate.

  • You have received an urban-renewal proposal and want to assess the economic terms.

  • You received a Betterment Levy assessment in Israel and want to examine the valuation.

  • You already have a previous appraisal and need an updated value.

U.S. Tax Matters Relevant to Israeli Property

Worldwide Income & U.S. Taxation

One of the most important features of the U.S. tax system is that U.S. citizens and U.S. resident aliens generally report worldwide income.

This can include:

  • Rental income from Israeli property

  • Capital gains from the sale of Israeli property

  • Other income connected with foreign property

The fact that the property is located in Israel does not, by itself, remove the income from the U.S. tax system.

The client's U.S. tax adviser determines the applicable U.S. tax treatment.

Why the Valuation Date Matters

Property value is not a fixed number.

An Israeli apartment may have had one market value when it was purchased, another value when it was inherited, and another value when it is eventually sold.

A U.S. tax matter may require market value as of a particular date.

For example:

  • Value at acquisition

  • Value at the date of a gift

  • Value at the date of death

  • Value at another historical date

  • Value at disposal

An appraisal prepared today does not automatically establish the property's market value on an earlier date.

For a historical valuation, the property's characteristics and the available Israeli market evidence for the relevant period need to be examined.

Capital Gains Tax — Tax on an Israeli Property Sale

U.S. Capital Gains Tax

A U.S. taxpayer may have a U.S. capital-gain reporting obligation when Israeli real estate is sold.

The U.S. tax calculation may require information about:

  • Acquisition price

  • Acquisition date

  • Capital improvements

  • Selling expenses

  • Depreciation, where applicable

  • Sale proceeds

  • Relevant historical market values

  • Foreign taxes paid

  • Currency conversion

Depending on the circumstances, the sale may be reported using Form 8949 — Sales and Other

Dispositions of Capital Assets and Schedule D — Capital Gains and Losses.

The U.S. tax adviser determines the applicable basis, gain and reporting treatment.

Our role is to provide the Israeli property valuation where a valuation is required or useful.

Historical Valuation & U.S. Tax Basis

Historical property value can become particularly important when the actual amount paid does not establish the relevant U.S. tax basis.

For example, certain transfers, gifts and inheritances use special basis rules.

A valuation may therefore be required for a date that occurred many years ago.

Example

A U.S. taxpayer purchased an apartment in Tel Aviv many years ago and is now preparing to sell it.

The tax adviser needs information concerning the property's value at a particular historical date.

IL APPRAISER can prepare an Israeli valuation for that specific date, subject to the available evidence.

The valuation date and purpose should be agreed before the appraisal is prepared.

Inherited Property & Fair Market Value

Step-Up in Basis

For property inherited from a decedent, the U.S. tax basis is generally the property's fair market value at the date of death, or an alternate valuation date where an estate tax return is filed and the executor elects the alternate valuation method.

This makes an independent valuation particularly relevant when an inherited Israeli property is later sold.

Example

A U.S. citizen inherits an apartment in Jerusalem.

The apartment is valued at $900,000 at the date of death and is later sold.

The U.S. tax adviser needs to establish the property's basis and calculate the later gain.

An Israeli appraisal prepared as of the date of death can provide professional evidence of the property's market value at that date.

The tax adviser determines the final tax basis and calculation.

Rental Income from Israeli Property

Israeli rental income can be subject to U.S. reporting for U.S. citizens and resident aliens.

Rental real-estate income and expenses are generally reported on Schedule E (Form 1040).

The tax calculation may require consideration of:

  • Gross rental income

  • Operating expenses

  • Repairs and improvements

  • Depreciation

  • Ownership percentage

  • Foreign taxes

  • Exchange rates

The tax treatment is handled by the client's U.S. tax adviser.

But What Is the Property Actually Worth to Rent?

This is a separate question.

IL APPRAISER can provide an independent market rental-value assessment based on:

  • Location

  • Property type and size

  • Condition

  • Floor and characteristics

  • Parking and storage

  • Furnishing

  • Lease terms

  • Comparable Israeli rental properties

  • Current market conditions

This service may be useful even where there is no tax-reporting issue.

Foreign Tax Credit

Form 1116 — Foreign Tax Credit

A U.S. taxpayer who pays or accrues certain foreign taxes may be able to claim a Foreign Tax Credit.

For individuals, estates and trusts, the relevant form is generally Form 1116 — Foreign Tax Credit.

Where Israeli tax has been paid in connection with income or gains, the client's U.S. adviser may need to examine whether a credit is available and how the foreign tax is categorized.

The availability and amount of the credit depend on the taxpayer's circumstances and the applicable U.S. rules.

IL APPRAISER does not calculate the foreign tax credit.

Where a property valuation is relevant to the underlying tax matter, we provide the Israeli valuation.

Form 8938 — Foreign Financial Assets - An Important Distinction

Form 8938 — Statement of Specified Foreign Financial Assets is often associated with foreign assets, but directly held foreign real estate is not itself a specified foreign financial asset that must be reported on Form 8938.

For example, a U.S. taxpayer who directly owns an Israeli apartment does not report the apartment itself on Form 8938 merely because it is foreign real estate.

The result can be different where the real estate is held through a foreign entity. In that case, the taxpayer's interest in the foreign entity may itself be a specified foreign financial asset.

The applicable reporting requirements depend on the ownership structure and the taxpayer's circumstances.

Form 8938 Thresholds for Taxpayers Living Abroad

For qualifying taxpayers living abroad, the thresholds are generally higher than for taxpayers living in the United States.

For an unmarried taxpayer or a married taxpayer filing separately, Form 8938 generally becomes relevant when specified foreign financial assets exceed:

  • $200,000 at year-end or

  • $300,000 at any time during the year

  • For married taxpayers filing jointly and living abroad:

  • $400,000 at year-end or

  • $600,000 at any time during the year

These thresholds concern specified foreign financial assets, not the value of directly held Israeli real estate itself.

FBAR — Foreign Bank Accounts

The Foreign Bank Account Report (FBAR), filed electronically as FinCEN Form 114, is a separate reporting regime concerning foreign financial accounts.

Directly held foreign real estate is not an FBAR-reportable account.

However, an Israeli bank account associated with the taxpayer or with rental activity can create a separate FBAR question if the applicable conditions and thresholds are met.

This distinction is important:

  • Israeli apartment → not an FBAR account

  • Israeli bank account → may create FBAR obligations

The taxpayer's U.S. tax adviser should determine whether FBAR reporting is required.

Estate Tax & Israeli Real Estate

U.S. Estate Tax

U.S. estate-tax treatment depends significantly on whether the deceased was a U.S. citizen, a U.S. resident for estate-tax purposes, or a nonresident who was not a U.S. citizen.

For a U.S. citizen, the federal estate-tax system generally considers worldwide assets.

For estates of decedents dying in 2026, the federal basic exclusion amount is $15 million.

The principal federal estate-tax return is:

Form 706 — United States Estate (and Generation-Skipping Transfer) Tax Return

For a U.S. citizen or U.S. resident, Form 706 is generally required when the gross estate plus certain adjusted taxable gifts exceeds the applicable exclusion amount, subject to the detailed filing rules.

Example:

A U.S. citizen living in Israel dies owning an apartment in Herzliya together with other assets.

The executor needs to establish the value of the Israeli apartment as part of the worldwide estate.

An independent Israeli appraisal can provide evidence of the property's fair market value at the relevant date.

The estate's attorney and tax adviser determine whether Form 706 is required and how the property value is reported.

Nonresident Noncitizens

A person can be a U.S. income-tax resident without being a U.S. estate-tax resident.

For a nonresident not a citizen (NRNC), the U.S. estate-tax regime generally focuses on property situated in the United States.

Form 706-NA is the relevant estate-tax return for an NRNC estate when the filing requirements are met.

Israeli real estate held directly is outside the United States, so its treatment is different from U.S.-situated real property.

Ownership through a foreign entity can create a different analysis.

Because estate-tax situs and treaty questions can be complex, the client's estate-tax adviser should determine the applicable rules.

Gifts of Israeli Property

Transferring Israeli real estate as a gift can create separate U.S. gift-tax considerations.

The relevant federal return is:

Form 709 — United States Gift (and Generation-Skipping Transfer) Tax Return

For gift-tax purposes, the value of the property is generally its fair market value on the date of the gift.

IRS instructions state that adequate disclosure of a gift on Form 709 may include either a qualified appraisal or a detailed description of the method used to determine the property's fair market value.

This makes an independent appraisal potentially important where Israeli real estate is transferred as a gift.

Example

A U.S. citizen transfers an apartment in Israel to a family member.

The U.S. adviser needs to establish the property's fair market value on the date of the transfer.

IL APPRAISER can prepare an Israeli appraisal as of the gift date, subject to the applicable information and evidence.

The U.S. tax adviser determines the gift-tax consequences and filing requirements.

U.S. Tax Forms That May Be Relevant

Form 706

Form 709

The client's U.S. tax adviser should determine which forms actually apply.

U.S. Filing & Payment Dates — 2026

For calendar-year individual taxpayers, the regular federal filing and payment deadline in 2026 was 15 April 2026.

U.S. citizens and resident aliens who qualified as taxpayers living abroad generally received an automatic two-month extension to file, making the date 15 June 2026.

A further extension can generally move the filing deadline to 15 October 2026.

An extension to file does not generally extend the time to pay federal income tax due.

FBAR

FBAR is generally due 15 April, with an automatic extension to 15 October.

Taxpayers should always verify their individual filing position because filing deadlines can vary due to residence, filing status, disasters or other special circumstances.

2026 Legislative Update

Estate & Gift Tax Exemption

For 2026, the federal basic exclusion amount for U.S. estate and gift tax purposes is:

$15,000,000

The annual gift-tax exclusion for gifts to a particular recipient is:

$19,000

These amounts were increased or maintained under the federal tax legislation enacted in 2025 and the related 2026 inflation adjustments.

The applicable rules can differ depending on the taxpayer, type of transfer, marital status and other circumstances.

Beyond Tax Reporting — How We Can Help

An Israeli property valuation is not only a tax document.

You Are Considering Buying a Property

Before committing to a purchase, we can provide an independent reference point for market value.

This can help you compare between Asking Price vs. Market Value, and identify questions that may require further legal, planning, or financial review.

You Own a Property and Want to Know the Rental Value

We can assess the property's market rental value.

This may be useful when:

  • Considering a new rental

  • Reviewing an existing lease

  • Comparing rental alternatives

  • Planning a purchase for investment

  • Reviewing an investment property

You Received an Urban Renewal Proposal

If you have been approached regarding urban renewal / Pinui-Binui / Tama 38, you may need to understand whether the proposed consideration is appropriate.

From the apartment owner's perspective, an appraisal may examine:

  • Existing apartment value

  • Proposed consideration

  • Size and characteristics of the replacement apartment

  • Parking and storage

  • Floor and location

  • Additional economic components of the proposal

  • Market rent during the evacuation period

  • Existing appraisal or Standard 21 material

The Government Authority for Urban Renewal recommends that apartment owners examine developer proposals and their economic value before signing an agreement.

We can provide an independent assessment from the owners' perspective.

You Received a Betterment Levy Assessment

The Israeli Betterment Levy ("Heitel Hasbaha") is connected to an increase in land value arising from planning events such as approval of a plan, a relief or permitted exceptional use.

The statutory framework is contained in the Planning and Building Law, 1965, particularly the Third Schedule,

If you have received a Betterment Levy assessment, we can review the valuation basis, the property's planning circumstances and the underlying market evidence.

Where there are professional valuation grounds for doing so, the appraisal may support an objection, appeal or other appropriate procedure.

The applicable legal procedure should be handled with the client's legal adviser.

You Are Considering an Investment

A valuation can provide an independent property reference point before you commit capital.

For example, you may want to compare:

Purchase Price with Independent Market Value

and separately consider:

Expected Rental Income against Market Rental Value

We provide the real-estate analysis. The investment decision remains with the client and their professional advisers.

What Does IL APPRAISER Provide?

Depending on the assignment, the appraisal may address:

  • Property identification

  • Location and surroundings

  • Physical characteristics

  • Registered rights

  • Planning status

  • Building rights

  • Existing leases or occupancy

  • Comparable transactions

  • Rental evidence

  • Market conditions

  • Valuation methodology

  • Market value

  • Market rental value

  • Historical valuation date

  • Supporting analysis

Where the valuation is being prepared for a U.S. professional adviser, we can discuss the purpose, valuation date and any specific documentation requirements before the engagement begins.

Need an Updated Valuation for the Same Property?

Updating an Existing Israeli Property Valuation

If you previously commissioned an appraisal of the same Israeli property, we can review the existing file and, where appropriate, prepare an updated valuation for a new valuation date.

This may be useful when:

  • The property becomes relevant to a later tax year

  • A property is being sold after several years

  • An estate matter has developed

  • A previous valuation is no longer current

  • A lawyer or accountant needs an updated professional reference point

A previous appraisal is useful background information but does not automatically establish the property's current market value.

Frequently Asked Questions

Do all U.S. taxpayers who own Israeli property need an Israeli professional appraisal?

No. The need for an independent appraisal depends on the circumstances, the purpose of the valuation and the applicable U.S. tax rules.

Does directly owning an Israeli apartment require Form 8938?

Not by itself. The IRS specifically states that foreign real estate held directly is not a specified foreign financial asset for Form 8938 purposes. Different rules may apply where the property is held through a foreign entity.

Does directly owning Israeli real estate require FBAR reporting?

No. Directly held foreign real estate is not a foreign financial account. An Israeli bank account, however, may create separate FBAR reporting requirements.

Can you prepare a valuation for the date of death?

Yes. We can prepare a valuation for a specified historical date, subject to the available property and market evidence.

Can you prepare a valuation for a gift of Israeli property?

Yes. We can provide an independent market valuation as of the date of the gift.

Can you provide a valuation for a U.S. Capital Gains matter?

Can you assess the rent I could receive for my Israeli property?

Yes. We can provide a market rental-value assessment based on the property's characteristics and relevant Israeli rental evidence.

Can you work directly with my CPA or attorney?

Yes. We can coordinate directly with professional advisers according to your preference.

Can you update an old Israeli appraisal?

Can you handle the process remotely?
